Removal of Conditions

If you received a 2-year Green Card through marriage to a U.S. citizen (and were married less than two years at the time), you must file to remove conditions before it expires. Even if USCIS mistakenly issues a 10-year card, the process still applies. 

Our Process: 

  1. Consultation with theWay, Inc. team to review your case. 
  1. Document Collection – including Form I-751 and supporting evidence like: 
  • Photos together 
  • Joint financial documents 
  • Birth certificates of children 
  • Letters from family/friends 
  1. Submission – We file your petition up to 90 days before your card expires. 

After Filing: 

  • USCIS may issue a 48-month extension while processing. 
  • You may apply for citizenship during this time if eligible (3 years with a U.S. citizen spouse). 
  • If you don’t pursue citizenship, you’ll need to renew your Green Card after approval. 

Special Circumstances: We handle complex cases involving: 

  • Divorce 
  • Spousal abuse 
  • Widowhood 
  • Expired Green Cards 

Children with 2-Year Green Cards must also go through this process, with additional considerations based on age and timing. 

Asylum 

We handle affirmative asylum cases—those filed outside of immigration court. These involve an interview but no court hearings. 

Key Points: 

  • We’re selective and only take strong cases with solid evidence. 
  • Common grounds include political or religious persecution, or lack of protection from domestic abuse. 
  • Many of our clients come from the Middle East and other high-risk regions. 

Timing Matters: 

Asylum should be filed as soon as possible after arriving in the U.S. While we’ve won cases filed after one year, they are more difficult to win. 

TPS and Other Relief 

Temporary Protected Status (TPS) is available to individuals from designated countries experiencing armed conflict, natural disasters, or other extraordinary conditions. TPS allows eligible individuals to live and work in the U.S. temporarily without fear of deportation. 

We also assist with other forms of immigration relief, including: 

  • Humanitarian parole 
  • Deferred Action 
  • U visas for victims of certain crimes 
  • VAWA (Violence Against Women Act) petitions 
  • Special Immigrant Juvenile Status (SIJS)
